LactiGo, Inc. (“LactiGo,” “we,” “us”) develops and sells performance and recovery products. We operate mainly in the United States and Canada, with some sales to other countries. We collect and use Personal Information to process orders, provide customer service, and improve our products and website. We may share data with trusted service providers such as payment processors and shipping partners but never sell your Personal Information.   1. Introduction

LactiGo, Inc. values your privacy and is committed to protecting it through this Privacy Policy. This document explains how we collect, use, disclose, and protect your Personal Information when you visit our websites, use our applications, or interact with us electronically.

LactiGo, Inc. is the data controller responsible for processing your personal data. For inquiries under the EU or UK GDPR, our Privacy Office may be contacted as set forth in the Contact Information section below.

Please also review our Terms of Use which together with this Privacy Policy governs your use of LactiGo websites and applications (the “LactiGo Sites”).

By using any part of the LactiGo Sites or by agreeing electronically, you consent to our data practices as described in this Privacy Policy.

International Transfers

If you access the LactiGo Sites from outside the United States, your information will be transferred to and processed in the United States, which may not provide the same level of data protection as your home country. By proceeding to use the LactiGo Sites and providing your Personal Information, you consent to the transfer, storage, processing, and disclosure of your Personal Information as described herein.

Personal Information collected from Canadian residents may be transferred to and processed in the United States. We use contractual or other measures to ensure a comparable level of protection as required under Canadian law.

Children and Privacy

The LactiGo Sites are not intended for children under 16 years of age. We do not knowingly sell or share Personal Information of consumers under 16 years of age. We do not knowingly attempt to solicit or receive information from children. If you believe your child has provided us with Personal Information, please alert us at privacy@lactigo.com. If we learn that we have collected Personal Information from a child under 18, we will promptly take steps to delete such information and terminate the child’s account.

  1. How We Collect Your Personal Information

In this Privacy Policy, “Personal Information” (also called “personal data” in some regions) means any information that identifies, relates to, describes, or could reasonably be linked to an individual. This includes things like your name, contact details, payment information, IP address, or device identifiers. It does not include aggregated or anonymized information that cannot reasonably be used to identify you. 

LactiGo does not collect or process Sensitive Personal Information for purposes other than those expressly permitted by applicable U.S. state privacy laws, such as processing payments, securing accounts, preventing fraud, and complying with legal obligations.

1. Information You Provide

You may provide Personal Information to us through the LactiGo Sites, or through other means, such as text message, email, mail or other ways you interact with us. This may include:

  • Information that you provide by filling in forms on the LactiGo Sites. This includes information provided when you apply to become a LactiGo Affiliate or LactiGo Brand Ambassador, at the time of registering to use the LactiGo Sites, purchasing products, creating an account, or requesting further services. We may also ask you for information when you enter a promotion sponsored by us and when you report a problem with the LactiGo Sites. This includes contact information, such as name, email, and phone number. 

  • Payment information, such as name, bank information, billing address, and payment card details, including card number, expiration date, and security code, which is collected and stored by our third-party payment processor on our behalf.

  • Your responses to surveys that we might ask you to complete for research purposes.

  • Your search queries on the LactiGo Sites.

  • Records and copies of your correspondence (including email addresses) if you contact us. If you send us an email communication, we may collect the following Personal Information from you:

    • Email address

    • IP address

    • Date and time of communication

    • Content of communication

We gather this information to facilitate the conversation you started with us, to prevent the misuse of our email service, and to protect the security of our information technology systems.

2. Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with the LactiGo Sites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the LactiGo Sites and other communication data and the resources that you access and use on the Website.

  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). We do not respond to Do Not Track requests. However, we recognize Global Privacy Control (“GPC”) signals as required by applicable law. Because LactiGo does not sell or share Personal Information for cross-context behavioral advertising, GPC signals do not alter our data collection or use practices.

The information we collect automatically may include Personal Information, or we may maintain it or Affiliate it with the Personal Information we collect in other ways or that we receive from third parties. It helps us to improve the LactiGo Sites and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize the LactiGo Sites according to your individual interests.

  • Speed up your searches.

  • Recognize you when you return to the LactiGo Sites.

The technologies we use for this automatic data collection may include:

  • Cookies - When using the LactiGo sites, various types of cookies are used and stored on your computer. Cookies are small text files stored on your device that tell websites who you are. Through your browser's settings, you can disable, limit, or delete cookies. However, we cannot accomplish many of the functions needed to create and process an order on the LactiGo Sites without cookies. For this reason, we recommend you keep cookies activated. We have broken up our cookies into categories to help you understand what they do.

    • Essential: These cookies are required to use the LactiGo Sites. For example, they are necessary to add items to your cart and check out.

    • Performance: These cookies track how you interact with the LactiGo Sites. For example, Google Analytics lets us know which pages load slowly or are not optimized for mobile use. We use this information to improve our user experience.

    • Functionality: These cookies track information about you to make using the LactiGo Sites easier. For example, we use this information to store a language preference.

    • Marketing and Advertising: These cookies help us create targeted advertising experiences for you.

  • Server Log Files - The website provider automatically collects and stores information your browser automatically transmits to us in “server log files.” These are:

    • Referrer URL

This data will not be combined with data from other sources.

3. Information we collect through LactiGo Affiliates and Brand Ambassadors

We may also collect personal data about you from “LactiGo Affiliates” or “LactiGo Brand Ambassadors,” independent contractors to which we have granted rights to promote and/or sell our products and services. LactiGo requires Affiliates and Brand Ambassadors to comply with applicable privacy and marketing laws under their contracts.

  1. How We Process Your Information

We collect, process, and use personal data only insofar as it is necessary to establish or modify legal relationships with us. We collect, process, and use your personal data when accessing the LactiGo Sites (usage data) only to the extent required to enable you to access our service or to bill you for the sale. Personal Information we collect from customers will be deleted after completion of the order or termination of the business relationship unless LactiGo has a legal right or obligation to retain the information for a longer period.

We may also use your information to contact you about our own goods and services that may be of interest to you. We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Analytics and Third-Party Tools

When visiting the LactiGo Sites, your surfing behavior may be analyzed. This happens primarily using cookies and web beacons. The analysis of your surfing behavior is usually anonymous, i.e., we cannot identify you from this data. You can object to this analysis or prevent it by not using certain tools.

  1. How We Protect Your Information

LactiGo has implemented appropriate physical, technical, and administrative standards to protect Personal Information from loss, misuse, alteration, or destruction. Our service providers and affiliates are contractually obligated to protect the confidentiality of your Personal Information and may not use the data for purposes not authorized by us.

Although we do our best to protect your Personal Information, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal identification information, you acknowledge that there are security, integrity, and privacy of any and all information and data exchanged between you and us through the LactiGo Sites cannot be guaranteed. Please do your part in protecting your Personal Information by keeping your account password safe and confidential, logging out of your account after using a shared computer, and regularly scanning your computer for viruses, malware, and spyware. Please protect your account credentials and notify us immediately of any unauthorized use.

By using the LactiGo Sites, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the LactiGo Sites. If we learn of a security breach involving your Personal Information, we may attempt to notify you electronically by sending you an email. Data Breach Notification

In the event of a data breach involving your Personal Information, LactiGo will comply with all applicable federal and state laws requiring notification. If we experience a data breach, we may contact you electronically. To withdraw consent to electronic notice, email us at privacy@lactigo.com.

Data Retention Policy

We retain personal data only as long as necessary for its original purpose or as required by law. Examples include: - Customer order and payment data: up to 10 years (for tax and legal obligations) - Marketing and communication data: up to 2 years after last interaction - Affiliate records: up to 7 years after contract termination. LactiGo retains Personal Information only for as long as is reasonably necessary to fulfill the purposes for which it was collected or as otherwise required by law.

Social Media Links and Third-Party Sites

LactiGo Sites may contain links to other websites that are not operated by us. If you click on a link to a third-party site, you will be directed to their site. We have no control over these sites, we cannot protect your personal data, and we strongly advise you to review the privacy policy of every site you visit. The LactiGo Sites also offer social sharing features, including but not limited to links to Facebook, Twitter, LinkedIn, Instagram, Google+, Pinterest, Vimeo, and YouTube, which allows you to access your social media account to share actions you take on the LactiGo Sites with your friends or the public depending on the settings of your social sharing account.   1. How We Disclose Your Personal Information

We may disclose your Personal Information as follows:

  • To LactiGo’s employees and third parties who provide technical or organizational services for LactiGo and are required and have agreed to protect your data.

  • We grant rights to LactiGo Affiliates and LactiGo Brand Ambassadors to promote and/or sell our products and services. LactiGo Affiliates and Brand Ambassadors are independent contractors, not employees of LactiGo. Therefore, we have no control over the collection, use, or disclosure of Personal Information by LactiGo Affiliates or Brand Ambassadors for marketing or other purposes, nor do we assume any responsibility or liability for this. If you provide a LactiGo Affiliate with information through the LactiGo Sites, we will have access to this information and the information will be handled in accordance with this privacy policy. LactiGo Affiliates and Brand Ambassadors may provide LactiGo with information about their customers, which we will handle in accordance with this Privacy Policy upon receipt of the information. If you are a customer of a LactiGo Affiliate or Brand Ambassador or have shared your information directly with a LactiGo Affiliate or Brand Ambassadors, please contact your LactiGo Affiliate or Brand Ambassador directly to learn about their data protection practices.

  • In the case of payment processing for orders, the data for processing the payment transaction is passed on to the payment service provider who is bound by instructions. The LactiGo Affiliate or Brand Ambassador through whom you place an online order is only informed whether the transaction has been completed. Your LactiGo Affiliate or Brand Ambassador will not receive any information about your account unless you provided your information directly to the LactiGo Affiliate or Brand Ambassador or have given your consent in advance.

  • To third parties who provide logistics and order fulfillment services, such as shipping companies for transporting orders and credit card companies for billing. These service providers are prohibited from using your Personal Information.

  • In the case of a merger, acquisition by another company, or sale of all or part of LactiGo’s assets, in which case your Personal Information may also be included in the transferred assets.

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

  • To third parties to market their products or services to you if you have not opted out of these disclosures or if you have opted in if you live in a jurisdiction that requires affirmative opt in prior to such disclosure. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. LactiGo does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising as those terms are defined under applicable California law.

  1. Notice Concerning the Party Responsible for This Website

The party responsible for processing data on this website (i.e., the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data) is LactiGo, Inc.

  1. Data Transfers

LactiGo operates in several different countries across. To enable us to offer consistent service to you, wherever you may be, we manage certain website functions from one central location. This is currently in the U.S. In addition, if you are a Lactigo Affiliate, members of your Team may be established in the U.S or other countries. There is not one set of data protection laws that cover Europe, the U.S. and other parts of the world. The European laws require that LactiGo take steps to protect the personal data of residents of the European Economic Area, Switzerland, and the United Kingdom when it is transferred to regions outside of Europe. Those steps include contractual restrictions on the processing of your personal data and incorporating Standard Contractual Clauses (with the UK or Swiss Addendum to EU SCCs, as applicable) when required by law.

  1. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information: 

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data (the order form or registration form). You can also always opt-out by logging into the Website and adjusting your user preferences in your account profile or by sending us an email with your request to privacy@lactigo.com.

Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to privacy@lactigo.com.If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience, or other transactions.

Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email stating your request to privacy@lactigo.com.

We do not control third-party collection or use of your information to serve interest-based advertising. However, third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Some U.S. states provide residents with additional Personal Information rights and choices. Please see our State Privacy Rights for more information.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated e-mail address: Privacy@LactiGo.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

1. Right to Access

You have the right to request confirmation of whether we process your personal data and, if so, to access that data and obtain a copy of the following information:

Under specific circumstances, you can request the deletion of your personal data, including when:

  • You object to the processing, and there are no overriding legitimate grounds.

9. Right to Be Informed About Automated Decision-Making

You have the right to be informed about and object to decisions made solely on automated processing, including profiling, if such decisions produce legal or similarly significant effects on you.

We do not currently use automated decision-making processes that have significant legal effects on users. If this changes, we will notify you and provide meaningful information about the logic, significance, and consequences involved.

We will respond to your request as required under the applicable data privacy law and may extend this period by an additional two months for complex requests. You will be notified if an extension is necessary.

This section applies solely to residents of the State of California and supplements the information contained elsewhere in this Privacy Policy. It is provided in accordance with the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”).

  • Not receive discriminatory treatment for exercising privacy rights


Global Privacy Control

LactiGo recognizes Global Privacy Control (“GPC”) signals as a valid request to opt out of the sale or sharing of Personal Information. Because LactiGo does not sell or share Personal Information, GPC signals do not change our data practices.


How to Exercise California Rights

California residents may exercise their privacy rights by contacting us using the methods described in the “Contact Information” section below. We will verify requests in accordance with applicable law and respond within the timeframes required by the CCPA/CPRA.

We may update this privacy policy from time to time. We will notify you of any changes by posting the new privacy policy on this page. If we make any material changes to how we treat your Personal Information, we will notify you by email at the primary email address specified in your account and/or through a notice on our LactiGo Sites’ home page(s). However, we will not use your Personal Information in a manner materially different than what was stated when it was collected unless you consent.

You are responsible for ensuring we have an up-to-date email address to contact you. You are advised to review this privacy policy periodically for any changes. Your continued use of the LactiGo Sites after such modifications will constitute your acknowledgment of the modified privacy policy and your agreement to abide and be bound by the modified policy.
